1. Who we are

usepresence is operated by samko labs, s. r. o., with its registered office at Trnková 451/12, 040 14 Košice - mestská časť Košická Nová Ves, Slovakia, IČO (Company ID): 53928881, DIČ (Tax ID): 2121532600 ("we", "us").

For the personal data of our account holders (the people and companies who sign up for usepresence), we act as the data controller under the EU General Data Protection Regulation (GDPR). This policy explains what we collect, why, and what your rights are.

2. When we act as a processor

usepresence hosts contact forms for our customers. When an end-customer submits a message through a contact form belonging to one of our customers, that customer — the account holder — is the data controller for the message, and we process it on their behalf as a data processor. If you contacted a company through a form hosted by usepresence, please direct privacy requests to that company first; we will assist them in responding.

3. What data we collect

• Account data — your name, email address, password (stored hashed), team and workspace details.
• Messages — messages submitted through contact forms hosted on our customers' sub-domains, including the sender's name, email address, and message content, and the replies sent from the inbox.
• Usage data — basic technical logs such as IP address, browser type, and pages visited, used for security and to keep the service running reliably.
• Cookies and local storage — we use only what is needed to keep you signed in (session cookie, CSRF protection) and to remember your theme preference. We do not use advertising or cross-site tracking cookies.
• Billing data — payments are handled by Stripe. Your payment card details are processed by Stripe and are never stored on our servers. We keep only what we need for invoicing, such as your billing name, address, and subscription status.

4. Why we process it (purposes and legal bases)

• Providing the service — creating your account, hosting your contact form, delivering messages to your inbox, and sending replies (performance of a contract, Art. 6(1)(b) GDPR).
• Billing — processing subscription payments and issuing invoices (performance of a contract and legal obligation, Art. 6(1)(b) and (c)).
• Security and reliability — protecting accounts, preventing abuse, and debugging problems (legitimate interest, Art. 6(1)(f)).
• Communication — service emails such as email verification, password resets, and important notices about your account (performance of a contract, Art. 6(1)(b)).

5. Who we share data with (sub-processors)

We never sell personal data. We share it only with service providers who help us run usepresence:

• Hosting provider — infrastructure on which the service and its database run.
• Stripe — payment processing for subscriptions.
• Email delivery provider — sending transactional emails and inbox replies.

We plan to offer AI-drafted reply suggestions. Before enabling this feature, we will name the AI provider here and update this policy; message content would be shared with that provider only to generate a draft reply for you to review.

6. International transfers

Where a provider processes data outside the European Economic Area, we rely on an adequacy decision of the European Commission or on Standard Contractual Clauses (SCCs) to protect the transfer.

7. How long we keep data

We keep account data for as long as your account exists. Messages are kept for as long as the account holder keeps them in their inbox. When an account is deleted, we delete or anonymise its data within a reasonable period, except where the law requires us to keep it longer (for example, invoices for tax purposes).

8. Your rights

Under the GDPR you have the right to access, rectify, and erase your personal data, to restrict or object to its processing, and to data portability. Where processing is based on consent, you may withdraw it at any time. To exercise these rights, contact us using the details below.

You also have the right to lodge a complaint with the Slovak supervisory authority: Úrad na ochranu osobných údajov Slovenskej republiky (Office for Personal Data Protection of the Slovak Republic), Hraničná 12, 820 07 Bratislava, dataprotection.gov.sk.
